Fixed overtime allowance: reconcile attendance and pay before claiming a difference

A fixed overtime allowance still needs comparison with statutory pay. Match the scope, recognized hours and payments already made.

Read what the fixed payment covers

This guide reconciles an existing fixed overtime arrangement. Check whether it covers overtime only or also night and holiday work. Ministry guidance explains that an agreement does not remove the obligation to pay a shortfall against statutory allowances.

Assume a workplace with at least five regular employees, ordinary 40-hour weekly scheduling, an established ordinary hourly wage of KRW 12,000 and applicable overtime premiums. Night/holiday overlap, flexible schedules and part-time rules are outside this example.

Late departure does not automatically establish overtime for the whole period. Work performed, breaks, employer direction and the applicable scheduling system matter. A message timestamp is supporting evidence, not proof of every surrounding hour.

Worked example: 20 agreed hours and 28 recognized hours

Example · Overtime only

  • Fixed payment: 12,000 × 1.5 × 20 = KRW 360,000.
  • Statutory allowance for recognized hours: 12,000 × 1.5 × 28 = KRW 504,000.
  • Difference to reconcile: 504,000 − 360,000 = KRW 144,000.
  • If KRW 50,000 of additional overtime was already paid, the remaining comparison amount is KRW 94,000.

Counting the eight extra hours at the basic hourly wage omits the premium. Failing to deduct the matching fixed payment double counts money received. Fewer hours than the fixed agreement do not by themselves establish a right to claw back the fixed amount.

Check the variables before concluding

  1. Confirm which wage items form ordinary wage and the correct hourly divisor.
  2. Separate overlapping night and holiday items rather than offsetting unrelated allowances.
  3. Check which payslip settles hours after the payroll cutoff.
  4. Confirm exceptions for smaller workplaces, part-time work and flexible schedules.

Ask about recognized time and pay separately

“I recorded 28 overtime hours in this payroll period. Please identify recognized hours and exclusions, then show the comparison of statutory pay against my KRW 360,000 fixed allowance and any additional payments.” Keep original attendance, the agreement and payslips if the figures remain disputed.
