Inclusive wage agreements and fixed overtime pay

A fixed overtime amount does not automatically cover every hour worked. Compare the contract, actual hours and statutory premium pay.

What the terms mean

An inclusive wage agreement bundles certain allowances into a stated wage. A fixed-overtime arrangement separately states an expected amount of overtime pay. Read the contract to see which hours and premiums it claims to cover.

Limits under case law and guidance

Validity depends on the job, whether hours can be measured, the agreement and whether statutory minimum pay is protected. The mere label “inclusive wage” does not remove the duty to pay any shortfall.

Example comparison

A reference overtime calculation is ordinary hourly wage × 1.5 × overtime hours for a covered workplace. Compare this with the overtime amount already paid; other night and holiday premiums may also matter.

What to keep

Retain the employment contract, payslips and a record of actual working hours. They are essential for a meaningful comparison.
